General Rental Conditions

Article 1 – APPLICABLE REGULATIONS

The present general terms and conditions are an integral part of the accommodation contract, which is subject to the tourist residence regime without any possibility of staying in the premises or domiciliation. Under no circumstances may the customer take advantage of the legal provisions relating to residential leases under common law.

Article 2 – RESERVATION

The reservation of an apartment in our tourist residence LES PATIOS DU MARAIS is valid only after acceptance of the client’s reservation by LES PATIOS DU MARAIS. This acceptance is at the entire discretion of LES PATIOS DU MARAIS.

Moreover, the reservation must, to be admissible, be guaranteed by a valid credit card issued by a notoriously solvent establishment and after communication of its parameters, notably number and expiry date, or have been the subject of a prior credit agreement with LES PATIOS DU MARAIS or be followed by the payment of a deposit or the complete payment of the stay. ( LES PATIOS DU MARAIS accepts the following credit cards: Visa, Mastercard and Union Pay). Please note that your credit card may be pre-authorized prior to check-in.

Different conditions may apply for promotional rates. In this case, the particularities mentioned under the tariff description on the booking page prevail over the conditions mentioned above.

Any reservation made for an entry date on the day of booking is accepted until 7pm, after which time it will be automatically cancelled without charge.

Article 3 – TERMS AND CONDITIONS OF PAYMENT – LATE PENALTIES

The full price of the stay must be paid before entering the apartment as well as any optional services for which additional charges may apply. The same will apply in case of extension of the stay. It is only at the end of these regulations that the rental becomes final.

In cases where it has been agreed that payment for a resident’s stay would be made by a third party, the resident -occupant – will remain personally responsible for the payment in question.

For promotional rates, the total prepayment at the time of booking may be specified. In this case, this particularity is mentioned under the tariff description on the booking page.

Early departure does not give rise to any refund. Any delay in payment will be accompanied by an increase of 1.5% per month of delay, as soon as the invoice is due for payment.

In the event of arrival and entry into the apartment outside of the scheduled reception hours, the payment will be taken, the next day, from the credit card registered at the time of booking.

Article 4 – RATES

The prices are indicated in euros and include all taxes and charges, excluding tourist tax and only include the provision of an apartment. Not included in this price are optional services such as daily or additional cleaning, breakfast, airport transfer, etc…
The tourist tax is 2.88€ (two euros and eighty eight cents) per adult and per night.

Prices are subject to change without notice and optional services are not included in the price regardless of the country. LES PATIOS DU MARAIS reserves the right to pass on any changes in terms of VAT rates or tourist taxes that may be decided upon at a later date.

Article 5 – MODIFICATIONS OF RESERVATION OR DURATION OF STAY

Subject to availability and at the discretion of the PATIOS DU MARAIS, the duration of the stay may be extended, without obligation to remain in the same apartment or at the same price.

Please note that any change in rates related to an extended stay or early departure will be applied retroactively to the client’s account from the date of arrival.

Article 6 – CANCELLATIONS / NON-REPLAYMENTS

Any cancellation must be notified in writing to the operator and will only be effective upon receipt.

Any cancellation made within 7 days prior to arrival will incur compensation equivalent to the total amount of the stay due; with the exception of bookings made less than 7 days prior to arrival and cancelled within 8 hours of booking.

From 20/07/2020 to 20/12/2020 any cancellation made within 7 days prior to arrival entails an indemnity equivalent to the total amount of the stay due; with the exception of reservations made less than 7 days prior to arrival and cancelled within 8 hours of the reservation.

Some promotional rates may be “non-refundable” regardless of the date of cancellation. In this case the cancellation conditions detailed above do not apply and the total amount prepaid will not be refunded for any reason whatsoever.

Failure to arrive [of the booking] in the event of a no-show cancellation will be deemed to be a “no show” and will be subject to the above cancellation charges.

Article 7 – OBLIGATIONS OF THE RESIDENT

The apartment will be made available to the resident in a good state of maintenance. The Resident will use the rented premises and their facilities in a reasonable and prudent manner. The resident must report any anomaly, missing or damaged objects, if any, within 4 hours of arrival. Upon the resident’s departure, the inventory and the state of cleanliness of the apartment will be checked by LES PATIOS DU MARAIS and any lack of inventory or damage to the apartment will be charged to the resident.

The resident gives a mandate to PATIOS DU MARAIS to enter the premises in order to carry out any form of maintenance, repair or control intervention.

LES PATIOS DU MARAIS reserves the right to enter the rented premises for security or any emergency measure.

Article 8 – LIABILITY

The responsibility of PATIOS DU MARAIS cannot be engaged in case of theft or damage of personal belongings, in the apartments, including in the individual mini-boxes, the common areas and all other dependencies or annexes of the Residence.

PATIOS DU MARAIS cannot be held responsible in the event that the Resident exceeds the capacity of the apartment.

The provisions of article 1952 and following of the civil code are neither opposable nor applicable to our tourist residence LES PATIOS DU MARAIS .

Article 9 – TERMINATION – PENALTIES – NON RENEWAL

The contract will be terminated automatically, without formality and without delay, in the event of non-performance by the resident of any of his obligations or inappropriate behaviour likely to disrupt the stay of the other occupants. The resident must leave the premises immediately and may be evicted if necessary with the assistance of the police.

The non-payment of the stay is worth renunciation to the benefit of the rental contract and entails the handing over of the keys to the PATIOS DU MARAIS and express renunciation to remain in the premises.

Article 10 – CASE OF FORCE MAJEURE

In case of force majeure or event beyond the control of the operator, the residence LES PATIOS DU MARAIS can not be held responsible for any changes in its service. No compensation can be claimed in this respect.

Article 11 – RESTRICTIONS

Our apartments are non-smoking and pets are not allowed in our establishment.

Article 12 – JURISDICTION OF THE COURTS

The present general conditions of rentals are governed by French law without prejudice to any protective imperative provisions that may be applicable in the country of residence of consumers.
